As of April 2025, Washington, Maine, Oregon, California, Colorado, and Minnesota are among those states that have passed legislation that holds companies liable for this, according to advocacy group Two Sides North America.
The policy approach is called “Extended Producer Responsibility,” which “intends to hold brand owners, licensees, importers, and distributors accountable for the entire lifecycle of their products, especially the take-back, recycling, and final disposal.”
